# Terms of Service

These Terms of Service ("Terms") govern your access to and use of Oten Drive (the "App" or "Service"), operated by Oten ("Oten", "we", "us", or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the Service.

Please also read our [Privacy Policy](https://oten.com/privacy), which is incorporated into these Terms by reference.

### 1. The Service

Oten Drive is a zero-knowledge, end-to-end encrypted file storage and synchronization service. Files are encrypted on your device before upload; we store only encrypted data and do not hold the keys needed to read it. We cannot access, decrypt, or recover your file contents.

### 2. Eligibility

You must be of the minimum age required in your jurisdiction to form a binding contract (generally at least 13, or 16 in some regions). By using the Service, you represent that you meet this requirement and that you are not barred from using the Service under any applicable law.

### 3. Your account

* You must register with accurate information and keep it up to date.
* You are responsible for all activity that occurs under your account.
* You must promptly notify us of any unauthorized use of your account.

### 4. Your encryption keys — critical responsibility

Because Oten Drive is zero-knowledge:

* Your password, PIN, and **Recovery Key** are the only means of accessing your encrypted data.
* We **never** receive these credentials in a usable form and **cannot reset, recover, or bypass them**.
* **If you lose your password and Recovery Key, your data will be permanently and irretrievably lost.** No one, including Oten, can recover it.

You are solely responsible for safeguarding your credentials and for maintaining your own backups where appropriate.

### 5. Your content and ownership

* You retain all ownership rights to the files and data you store in the Service ("Your Content").
* We claim no ownership over Your Content. Because it is end-to-end encrypted, we cannot read it.
* You grant us a limited, technical license to store, transmit, and sync Your Content **in encrypted form** solely to provide the Service.
* You are responsible for Your Content and for ensuring you have the right to store and share it.

### 6. Acceptable use

You agree not to use the Service to:

* Violate any law or regulation, or infringe the rights of others;
* Store, share, or distribute content that is illegal under applicable law;
* Attempt to gain unauthorized access to the Service, other accounts, or our systems;
* Interfere with, disrupt, or overload the Service or its infrastructure;
* Reverse engineer the Service except to the extent expressly permitted by law;
* Use the Service to harm minors or to distribute malware.

We reserve the right to suspend or terminate accounts that violate these Terms. Note that, due to our zero-knowledge design, we generally cannot inspect file contents; enforcement is based on available account-level information and reports.

### 7. Sharing features

The Service may allow you to share encrypted content with recipients you choose, subject to controls such as passwords, expiration dates, and roles (Viewer/Editor). You are responsible for whom you share with and for the access settings you apply. Recipients' use of shared content is also subject to these Terms.

### 8. Plans, storage, and payments

* The Service may offer a free tier (including a baseline storage quota) and paid plans with additional storage or features.
* Where paid plans are purchased through the Apple App Store, billing, renewals, and cancellations are handled by Apple in accordance with your Apple account terms.
* Prices and plan features may change; we will provide notice where required.

### 9. Service availability

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable from time to time due to maintenance, updates, or factors beyond our control.

### 10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE SECURE, UNINTERRUPTED, OR ERROR-FREE.

### 11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN PARTICULAR, BECAUSE THE SERVICE IS ZERO-KNOWLEDGE, WE ARE NOT LIABLE FOR ANY LOSS OF DATA RESULTING FROM YOUR LOSS OF YOUR PASSWORD, PIN, OR RECOVERY KEY.

### 12. Indemnification

You agree to indemnify and hold harmless Oten and its affiliates from any claims, damages, or expenses arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

### 13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases; encrypted data associated with a deleted account is removed from our systems as described in our Privacy Policy.

### 14. Changes to the Service and Terms

We may modify the Service or these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, notify you within the App. Your continued use after changes take effect constitutes acceptance.

### 15. Governing law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles, unless mandatory local law in your place of residence provides otherwise. _(Confirm jurisdiction with legal counsel.)_

### 16. App Store terms (Apple)

If you download Oten Drive from the Apple App Store, the following also apply:

* These Terms are between you and Oten only, not with Apple. Apple is not responsible for the App or its content.
* Your use of the App must comply with the Apple Media Services Terms and Conditions and Apple's Licensed Application End User License Agreement (EULA).
* Apple has no obligation to provide maintenance or support for the App.
* Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
